Landlord terms
1. Scope
These landlord terms supplement the platform terms and conditions and govern the special obligations of users who list vehicles for rental on the platform.
2. Minimum requirements
- The landlord may only list vehicles that they are entitled to rent out.
- The vehicle must be roadworthy, operational and lawfully insured.
- All information in the listing must be complete, correct and up to date.
- Hidden additional costs outside the transparently displayed booking components are not permitted.
- The landlord must correctly state whether they act privately or commercially.
3. Insurance
The landlord is solely responsible for ensuring that sufficient and lawful insurance cover exists for the rental of the specific vehicle.
In the MVP, the platform operator does not offer its own vehicle insurance and does not perform a coverage review in the legal sense.
4. Payment and payout
- The landlord authorizes the platform operator to collect the rental price through the platform and to pay out the landlord share in accordance with the payment and payout terms.
- The landlord accepts that the platform may deduct or offset its commission, permissible fees, chargebacks, refunds and justified counterclaims before payout.
- Payouts require a payout-capable Stripe Connect account, the required payment-service-provider and platform review, and the absence of opposing reasons such as chargebacks, disputes, open payment deficits, missing security-deposit payment, missing handover confirmation or verification deficits. The platform may withhold payouts until clarification.
5. Security deposit
- The security deposit is collected through the platform as a payment flow separate from the rental price.
- The landlord has no claim that the security deposit is automatically paid out together with the rental price.
- Retentions from the security deposit require a timely, documented and reasoned claim.
- The landlord is obliged to document payment receipt, return condition, claim documents, retentions and released remaining amounts correctly and completely through the platform.
6. Handover and return acceptance
- Before handover, a handover report must be created with condition, mileage, fuel or charge level, accessories and visible damage.
- Return acceptance must also be documented.
- The landlord must report damage, delays, no-shows and other irregularities to the platform without delay.
7. Tax and platform obligations
- The landlord is responsible for their own tax obligations. Upon request, they must provide all information and documents that the platform operator needs to fulfill statutory reporting, review or payment obligations.
- Where the platform creates rental-agreement-related documents in the name and for the account of the landlord, the landlord is obliged to store and keep current the data required for this purpose.
8. Consequences of breaches of duty
- Deferral or deactivation of listings
- Blocking of bookings
- Suspension or withholding of payouts
- Request for additional documents or re-checks
- temporary or permanent account suspension in the event of serious or repeated violations
9. Coordination with further rules
These landlord terms must be read together with the platform terms and conditions, the payment and payout terms, the verification policy, the general rental terms and the cancellation and refund terms.
